If a package is reported as delivered by the carrier but you believe it was not received, please contact us at gasemben.us@gmail.com as soon as reasonably possible so that we can investigate the matter with the carrier or fulfillment provider.

If you have already been charged for an order that is canceled due to such an error, Gasemben will provide an appropriate refund.

(iv) not circumvent, evade, or interfere with any measure intended to block, limit, modify, or control whether Agents access, use, or interact with the Services.

Nothing in this Section grants any Agent or third party permission to access or use the Services where such access is otherwise prohibited by these Terms or applicable law.

Gasemben may suspend or terminate your access to the Services, or any part thereof, when permitted by applicable law, including if you violate these Terms, engage in fraudulent or abusive conduct, or use the Services in a manner that may harm Gasemben, its customers, service providers, or other users.

You may stop using the Services at any time. Termination of access does not affect any rights, obligations, payments, claims, or liabilities that accrued before termination.

The following sections will survive termination to the extent applicable: Intellectual Property, Comments, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GASemben DISCLAIMS ALL IMPLIED WARRANTIES AND CONDITIONS, INCLUDING WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT OR REPRESENT THAT:

• THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;

• THE SERVICES WILL BE AVAILABLE AT ALL TIMES, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;

• THE INFORMATION PROVIDED THROUGH THE SERVICES WILL ALWAYS BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE;

• ANY PRODUCT WILL MEET YOUR PERSONAL EXPECTATIONS, PREFERENCES, OR INTENDED USE;

• DEFECTS OR ERRORS WILL BE CORRECTED;

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GASemben, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THE SERVICES, OR FROM ANY OTHER CLAIM IN ANY WAY RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT.

THIS LIMITATION INCLUDES, WITHOUT LIMITATION, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT OR PRODUCT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU ACKNOWLEDGE THAT THESE LIMITATIONS OF LIABILITY ARE AN ESSENTIAL PART OF THE AGREEMENT BETWEEN YOU AND GASemben AND THAT THE SERVICES AND PRODUCTS WOULD NOT BE PROVIDED ON THE SAME TERMS WITHOUT THESE LIMITATIONS.

NOTWITHSTANDING THE FOREGOING, NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Gasemben, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any and all losses, damages, liabilities, claims, demands, costs, and expenses, including reasonable attorneys' fees, asserted by any third party arising out of or relating to:
